Access Care Services, LLC (ACS) and Golden Guidance Resource Center

These Terms of Use (“Terms”) are a legally binding agreement between you (“you,” “User”) and Access Care Services, LLC, a Wisconsin limited liability company (“ACS,” “we,” “us,” “our”), governing your access to and use of our website(s), digital content, subscription offerings, and services, including the Golden Guidance Resource Center and any related pages, portals, downloads, and communications (collectively, the “Site”).

By accessing or using the Site, creating an account, purchasing an Annual Pass, subscribing, or using any ACS services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Site.


1. Who We Are and What We Provide

ACS provides non-medical consultation, education, care navigation support, care planning guidance, and resource and referral support. The Golden Guidance Resource Center provides educational articles, tools, resources, and related digital materials designed to help individuals and families better understand health and social service systems and options.

ACS may also offer individualized consultation services separate from the Golden Guidance Resource Center, typically under a separate Service Agreement or similar engagement terms.


2. Eligibility and User Responsibilities

You must be at least 18 years old to use the Site or purchase an Annual Pass. If you use the Site on behalf of another person or organization, you represent that you have authority to bind that person or organization to these Terms.

You agree that you will:

  • Provide accurate information (including when creating an account or purchasing access);
  • Maintain the confidentiality of your login credentials;
  • Notify us promptly of unauthorized account access; and
  • Use the Site lawfully and in accordance with these Terms.

You are responsible for your own access to the internet and any device(s) needed to use the Site.


3. Important Disclosures: Not Medical, Legal, or Financial Advice

The Site and Golden Guidance Resource Center provide general educational information only. Nothing on the Site is intended to be, or should be interpreted as, medical advice, nursing advice, legal advice, financial advice, or a substitute for professional services.

  • No clinician-patient relationship. Use of the Site does not create a clinician-patient relationship.
  • No attorney-client relationship. Use of the Site does not create an attorney-client relationship.
  • No individualized advice through content. Educational content may not apply to your situation. Always consult qualified professionals for individualized guidance.

If you believe you may have a medical emergency, call 911 or seek emergency care immediately.


4. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect information. The Privacy Policy is incorporated into these Terms by reference.


5. Accounts and Access

Some parts of the Site may require you to create an account or purchase access (including the Annual Pass).

You agree not to:

  • Share your login credentials;
  • Allow others to access paid content using your account; or
  • Circumvent access controls.

We may suspend or terminate accounts that violate these Terms.


6. Golden Guidance Annual Pass: Membership, Benefits, and Term

6.1 Annual Pass Term

The Golden Guidance Annual Pass provides access for a 12-month period beginning on the date of purchase (the “Term”), unless otherwise stated at checkout.

At the end of the Term, access may expire unless you purchase another Annual Pass.

6.2 Membership Benefits

During the Term, the Annual Pass may include:

  1. Digital access to the Golden Guidance Resource Center (as available during the Term);
  2. A 30% discount on eligible ACS consultation services, subject to Section 7; and
  3. The ability to submit questions that may be considered for future educational content, subject to Section 8.

We may add, remove, or modify features and content over time as part of ongoing improvements (see Section 11).

6.3 Who the Annual Pass Is For

Unless otherwise stated in writing, the Annual Pass is for individual use by the purchaser (or a single household for personal use if explicitly described at checkout). Commercial use, group sharing, or redistribution is not allowed.


7. 30% Discount on ACS Consultation Services

The Annual Pass may provide a 30% discount on eligible ACS consultation services during the Term.

Discount Terms:

  • The discount applies only to consultation services that are specifically designated as eligible by ACS.
  • The discount does not apply to third-party costs, fees, or services not provided directly by ACS.
  • The discount may not be combined with other promotions unless ACS explicitly allows it.
  • The discount has no cash value, is not transferable (unless ACS approves in writing), and may not be resold.
  • Consultation services may require a separate service agreement, scheduling availability, and payment terms.
  • ACS may modify pricing for consultation services at any time; your discount applies to the then-current price unless otherwise required by applicable law.

8. Question Submission Feature (Educational Use Only)

Annual Pass members may submit questions for consideration as topics for future educational articles, tools, or materials.

Important:

  • No guarantee of response or publication. Submission does not guarantee that ACS will respond directly or publish an article based on your question.
  • Not consultation. Question submission is not a substitute for individualized consultation.
  • No client relationship created. Submission does not create a professional-client relationship with ACS.
  • Educational use permitted. You grant ACS permission to use submitted questions (and general themes) to develop educational content. ACS will use reasonable efforts to avoid including personal identifying details if you include them, but you agree not to submit sensitive personal information, medical records, or confidential details.

If you want personalized guidance, you should schedule a consultation service directly with ACS.


9. Payments, Billing, and No-Refund Policy (Very Important)

9.1 One-Time Annual Fee

The Annual Pass is purchased via a one-time payment for the Term. Unless otherwise stated, there is no monthly billing.

9.2 All Sales Are Final – No Refunds

ALL PAYMENTS ARE FINAL. ACS DOES NOT OFFER REFUNDS, PARTIAL REFUNDS, PRORATED REFUNDS, CREDITS, OR CHARGEBACKS FOR ANY REASON.

This includes, without limitation:

  • Your decision not to use the Site or resources;
  • Dissatisfaction with content style, topic coverage, or frequency of updates;
  • Technical issues on your side (device, browser, internet service provider, email filtering, etc.);
  • Inability to access the Site due to events outside of ACS’s control (power outages, service disruptions, internet failures, hosting problems, software updates, third-party outages, acts of God, or other force majeure events);
  • Account access issues caused by incorrect login information, sharing credentials, or failure to maintain updated contact information.

9.3 Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute contrary to these Terms, ACS reserves the right to suspend or terminate your access and account, and to recover costs incurred in responding to the dispute to the extent allowed by law.


10. Electronic Communications + Records

By using the Site, you consent to receive communications from ACS electronically (email, Site notices, account messages). You agree that electronic agreements, notices, and disclosures satisfy legal requirements that such communications be in writing.

Renewal Notices and Expiration

ACS may send reminder notices before your Annual Pass expires, using the email address associated with your account. You are responsible for maintaining current contact information and ensuring emails from ACS are not filtered.

ACS may offer the opportunity to purchase another Annual Pass near or after expiration. ACS does not guarantee that pricing or benefits will remain the same from year to year.


11. Changes to the Site, Content, and Access

ACS may modify, update, add, remove, or discontinue any part of the Site, content, features, or access methods at any time.

We strive to provide consistent access to members, but we do not guarantee uninterrupted availability. From time to time, the Site may be unavailable due to maintenance, upgrades, third-party issues, or circumstances beyond our control.

No refunds will be provided due to changes, interruptions, or discontinuations.


12. Intellectual Property and Permitted Use

All content on the Site, including text, graphics, downloads, worksheets, templates, videos, logos, and the overall look and feel (collectively, “Content”), is owned by ACS or licensed to ACS and is protected by intellectual property laws.

You may:

  • Access Content for your personal, non-commercial use during your active Term (if applicable);
  • Print limited pages for personal use (unless otherwise restricted).

You may not:

  • Copy, reproduce, redistribute, republish, upload, post, transmit, or sell Content;
  • Create derivative works from Content;
  • Share member-only Content with non-members;
  • Use Content to train AI models, scrape data, or build competing products;
  • Remove copyright or proprietary notices.

Any unauthorized use may result in termination of access and may violate applicable laws.


13. User Conduct and Prohibited Uses

You agree not to:

  • Use the Site for unlawful purposes;
  • Harass, threaten, or defame others;
  • Post or transmit harmful code (viruses, malware, etc.);
  • Attempt to gain unauthorized access to our systems;
  • Interfere with the Site’s operation or security;
  • Misrepresent your identity or affiliation;
  • Use the Site in a way that violates privacy laws or others’ rights.

14. Third-Party Links and Resources

The Site may reference or link to third-party websites, resources, products, or services. We do not control third parties and are not responsible for their content, policies, or practices. Your use of third-party resources is at your own risk.


15. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, ACS disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and that the Site will be uninterrupted, timely, secure, or error-free.


16. Limitation of Liability

To the fullest extent permitted by law:

  • ACS, its owners, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages.
  • ACS will not be liable for damages related to your inability to access the Site due to factors outside ACS’s control (including internet disruptions or third-party outages).
  • ACS will not be liable for your reliance on educational content.

If ACS is found liable for any claim, ACS’s total liability will not exceed the amount you paid to ACS for the Annual Pass during the twelve (12) months preceding the event giving rise to the claim (or $100, whichever is greater), unless a higher amount is required by applicable law.

Some states do not allow certain limitations; in that case, limitations apply to the maximum extent permitted.


17. Indemnification

You agree to indemnify, defend, and hold harmless ACS and its owners, contractors, and affiliates from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from:

  • Your use of the Site;
  • Your violation of these Terms; or
  • Your infringement of any intellectual property or other rights of any person or entity.

18. Suspension and Termination

ACS may suspend or terminate your account and access at any time if:

  • You violate these Terms;
  • You engage in misuse of the Site or Content; or
  • We reasonably believe termination is necessary to protect ACS, users, or the public.

Termination does not entitle you to any refund.


19. Governing Law and Venue

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules.

Any legal action arising from these Terms or your use of the Site shall be brought in the state or federal courts located in Wisconsin, and you consent to their jurisdiction.


20. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date will reflect the most recent changes. Continued use of the Site after changes become effective constitutes your acceptance of the updated Terms.

If changes are material, we may provide notice through the Site or by email, but we are not required to do so.


21. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

These Terms, together with our Privacy Policy and any other policies referenced, constitute the entire agreement between you and ACS regarding the Site and supersede prior communications.
